License Agreement

Please read this PrecisionK Calculator License Agreement (“this agreement”) in full by scrolling down. This is a legal agreement between you (“the user”) and “the authors” (Dr. Malak Habib and Dr. Nicholas Howard Andrew) for the limited use of the PrecisionK Calculator (“the calculator”). By clicking “I Agree”, the user agrees to the terms of this agreement. If you do not agree to the terms of this agreement, then do not proceed to use this calculator, and close this window.

1. Intellectual Property Rights and Restrictions on Use

   The calculator and its underlying algorithms, design, and outputs are the exclusive intellectual property of the authors. All rights are reserved. The user is granted a non-transferable, non-exclusive license to access and use the calculator solely for the purpose of averaging multiple readings of anterior keratometry. The user is strictly prohibited from copying, modifying, distributing, or reverse-engineering any part of the calculator. Unauthorised reproduction, use, or distribution of the calculator or its components constitutes a breach of these terms and may result in legal action.

2. Data Privacy and Responsibility

   The calculator does not store, save, or transmit any data entered by the user. All data is processed transiently, and no records of individual calculations are received or retained by the authors. The user is reminded that the data involved may constitute private or protected health information. It is the user’s responsibility to ensure that all data entered is handled in compliance with the relevant privacy and health laws, including, but not limited to the Privacy Act 1988 (Cth).

3. Waiver of Liability

   The authors make no warranties regarding the accuracy, reliability, or suitability of the calculator’s outputs. The calculator is intended as an educational and clinical tool to supplement the user’s clinical decision making. To the fullest extent permitted by law, the authors are free from any and all liability for any direct, indirect, incidental, consequential, or punitive damages arising from or in connection with the use of the calculator. All outcomes, including refractive or surgical outcomes, resulting from the use of the calculator remain the sole responsibility of the user. The user acknowledges that any use of the calculator is at their own risk and assumes full responsibility for the consequences.

4. Modification of Terms

   The authors reserve the right to amend or update this agreement at any time. Any changes will be effective immediately upon update on the website. It is the user’s responsibility to review the terms of this agreement periodically. Continued use of the calculator following any changes constitutes acceptance of the revised terms.

5. Governing Law and Jurisdiction

   This agreement is governed and will be enforced by the laws of Australia.

6. User Acknowledgement
